Data protection

1. Member States shall apply Directive 95/46/EC to the processing of personal data carried out in the Member States pursuant to this Regulation.

Data Protection

Directive 95/46/EC is regulating the processing of personal data and its transmission or free movement. This directive is actually repealed by the General Data Protection Regulation (GDPR).

2. Regulation (EC) No 45/2001 shall apply to the processing of personal data carried out by the Commission pursuant to this Regulation.

Data protection is applicable in addition to governmental and community institutions and bodies, which is regulated in 45/2001/EC.
